Under Article 10 of Turkey’s Personal Data Protection Law No. 6698 (“KVKK”), we inform you as follows in our capacity as data controller.

1. Identity of the data controller

2. Personal data processed

As a website visitor, only the following personal data is processed:

• Identity and contact data (only if you submit the form): full name, email address, Mac model, RAM, and optionally practice/clinic name.
• Application content: the optional message you write on the form.
• Transaction security / technical data: data generated automatically through hosting and cookieless analytics, such as IP address, browser and device type, referring address and approximate location at country level.

3. Purposes of processing

• To receive, review and respond to your beta application,
• To answer your questions and applications,
• To keep the website secure, intact and available,
• To analyse site use in anonymous, aggregated form so we can improve the service.

4. Legal basis

Your personal data is processed on the following legal bases under KVKK Art. 5:

• Explicit consent: processing of your contact details when you fill in and submit the beta application form (Art. 5/1).
• Legitimate interest: site security and improving the service through cookieless statistics, provided this does not harm the data subject’s fundamental rights and freedoms (Art. 5/2-f).
• Legal obligation: where processing is required to fulfil a duty arising from legislation (Art. 5/2-ç).

5. Method of collection

Your personal data is collected electronically when you fill in the beta application form on the website, and automatically during your visit (the hosting provider’s technical logs and cookieless analytics).

6. Transfers

Your personal data may be transferred, limited to the purposes above and in accordance with KVKK Arts. 8 and 9, to:

• The hosting and form-service provider (to store the site and form submissions),
• The cookieless analytics provider (for aggregated statistics),
• Public authorities legally authorised to receive it (on request and as required by law).

These providers’ servers may be located outside Turkey, so data may be transferred in accordance with KVKK rules on transfers abroad. We do not sell your data to third parties for advertising or marketing.

7. Retention

Your personal data is kept for as long as needed for the purpose for which it was processed, and for any periods set by applicable legislation. When the purpose ends it is deleted, destroyed or anonymised.

8. Data-subject rights (KVKK Art. 11)

By applying to the data controller you have the right to:

• Learn whether your personal data is processed,
• Request information if it has been processed,
• Learn the purpose of processing and whether it is used in accordance with that purpose,
• Know the third parties to whom your data is transferred, in Turkey or abroad,
• Request correction of incomplete or inaccurate data,
• Request deletion or destruction of your data under the conditions in KVKK Art. 7,
• Request that correction, deletion or destruction be notified to third parties to whom the data was transferred,
• Object to a result against you arising from analysis of processed data exclusively by automated systems,
• Request compensation if you suffer damage because your data was processed unlawfully.

9. How to apply

You may send requests under KVKK Art. 11 by email to hello@seanspilot.com, in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller.

Your application must clearly identify you and state your request. It will be concluded as soon as possible and at the latest within thirty days, free of charge; if the process requires a further cost, the fee in the tariff set by the Board may be charged.

10. Client data is outside the scope of this notice

The Seanspilot desktop app processes audio, transcripts and notes from therapy sessions entirely on your device, offline, and does not send that data to any server or to this website. Therapy clients’ personal/health data is therefore not processed by this website. Disclosure and explicit-consent duties toward your clients remain those of the therapist or institution as data controller.
